U.S. retailers may not sell tobacco products, including e-cigarettes, to anyone under 21. Retailers must verify age using photo ID for purchasers under 30 when selling cigarettes, smokeless tobacco, and covered tobacco products. Nicotine from non-tobacco sources is also regulated.

Confirm applicable FDA marketing authorization and state or local product, flavor, and remote-sales restrictions. ENDS are generally nonmailable through USPS, with limited exceptions. Check the carrier and delivery arrangement separately.

The PACT Act’s ENDS definition can cover devices delivering nicotine, flavor, or another substance, and related components, liquids, parts, or accessories. Review product scope rather than relying only on a nicotine-free label. Different laws use different definitions.

Questions about vape age verification

Is the minimum age 21 for U.S. e-cigarette sales?

Federal law prohibits retail sales of tobacco products, including e-cigarettes, to anyone under 21. FDA also requires photo-ID age verification for purchasers under 30 for covered tobacco products. Review the requirements for your specific catalog and sales flow.

Can we check only the products that require verification?

Use supported product, category, and regional rules to focus checks on covered orders. Confirm configuration with BlueCheck and review coverage with counsel. Devices, e-liquids, components, and nicotine-free items may still fall within applicable rules.

Is clicking “I am 21” enough?

A click is a customer declaration. Review the required proof of age and purchase-time checks for your sales flow. Discuss supported verification methods with BlueCheck; a record lookup or declaration does not replace a required photo-ID check.

Does online verification replace delivery ID checks?

No. Delivery sales of ENDS have separate obligations under the PACT Act. Confirm adult signature, identification, and carrier procedures independently of the checkout check.
